Commission Terms

1. Operator and scope
The definitive operator information is being completed. Specific written terms in an accepted proposal prevail for that commission where they lawfully differ from these general terms.
2. Enquiry, proposal and contract
Submitting the website form is a request for information, not an order. After reviewing the subject and references, the artist may accept or decline the project or issue a written proposal stating the artwork, technique, support, dimensions, composition, price, taxes, included revisions, indicative timing, delivery and validity period. A contract is formed only when the proposal is expressly accepted and any stated booking payment is received.
3. Prices, tax and payment
Definitive tax, payment and booking-payment information will be published before enquiries are accepted.
No amount is charged through this website. Bank charges, currency conversion, transport, insurance and customs are only payable where identified before the contract or later expressly agreed.
4. Creation process, approvals and changes
The client must provide sufficiently clear lawful references and timely decisions. Artistic interpretation, handmade variation and the material characteristics described in the proposal are intrinsic to the work and are not defects. The proposal identifies any composition approval and included revision rounds. Changes outside that scope require prior agreement and may change price and timing. The artist will not make substantial out-of-scope changes without approval.
5. Timing and suspension
Any project-specific date is stated in the proposal and generally starts after acceptance, the booking payment and receipt of usable references. Delayed client responses, change requests, force majeure, illness, unavailable materials or transport disruption may reasonably extend the estimate. A material delay will be communicated.
6. Withdrawal and cancellation
Where the client is a consumer contracting at a distance, statutory withdrawal information is supplied before the contract. The right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised, where the legal exception applies; that consequence will be highlighted before acceptance. If a separable service is requested to begin during a withdrawal period, the artist will obtain the consumer’s express request and any legally required acknowledgement. For other client cancellations, only the terms stated in the accepted proposal and mandatory law apply; amounts for work properly performed and non-recoverable committed costs may be due where legally permitted.
7. Delivery, inspection and risk
Packaging, carrier, cost, insurance, customs and estimated transit are confirmed in the proposal. The client should inspect the package promptly and photograph visible transport damage before opening where possible, without prejudice to statutory rights. For consumers, risk passes only as provided by mandatory consumer law; these terms do not transfer risk earlier.
8. Conformity and complaints
Mandatory consumer conformity rights are not limited. Where the Portuguese consumer-goods regime applies, the trader is liable for lack of conformity appearing within three years after delivery, subject to the applicable statutory rules and remedies. Concerns should be reported with the order reference and clear photographs so they can be assessed, but failure to use a preferred contact method does not remove statutory rights.
9. References, copyright and publication
The client confirms having the right to provide the references for private creation and is responsible for instructions that unlawfully infringe third-party rights. Ownership of the physical artwork does not transfer copyright or grant reproduction, merchandising or commercial-use rights unless expressly agreed in writing. The artist does not publish client photographs, identifying details, locations or a private commission merely because they were submitted. Portfolio, press, advertising or social-media publication requires a separate agreement defining its scope and may be refused or withdrawn for future uses according to that agreement and applicable law.
10. Personal data
Personal data and private files are handled under the Privacy Policy. The privacy acknowledgement in the enquiry form records that the information was read; it is not used as the legal basis for necessary pre-contractual processing.
11. Complaints and dispute resolution
Information about a legally competent consumer ADR entity will be supplied where applicable; no voluntary adherence to a specific entity is claimed here.
12. Applicable law
Portuguese law applies, without depriving a consumer resident elsewhere of mandatory protections granted by the law of their country of residence. Any jurisdiction clause in an individual proposal is subject to mandatory consumer rules. If part of these terms is invalid, the remaining provisions continue to apply to the extent legally possible.
